These Rules are incorporated as part of the Terms of Service and are not meant as a replacement or a new agreement. Defined terms in the Terms of Use shall have the same meaning as used in these Rules.

In addition, the Site's Privacy Policy expressly applies, and any information provided by You to Sponsor will be subject to the terms of the Privacy Policy as well as the Terms of Service.

Woopla Inc. operates the Site. The Site offers the chance to play various Games for entertainment and enjoyment. The Site may also offer promotional contests which are entirely free to enter, including games played with Premium Funzpoints ("the Sweepstakes") and a Daily Jackpot Giveaway. Currently, virtual Premium Funzpoints, which are obtained completely for free and have no value, may be used to play the Premium Games for a chance to win further Premium Funzpoints that may - subject to the rules for redemption stated below - be redeemed by for a prize. Users may also accumulate virtual Tickets for entry into the Daily Jackpot Giveaway and win prizes subject to the rules for redemption stated below.

RULES AND REGULATIONS

1. SPONSOR

The Funzpoints Sweepstakes ("Sweepstakes") and the Funzpoints Daily Jackpot Giveaway ("Jackpot") (the "Contests," or each, a "Contest") are sponsored by Woopla Inc., 292 Charlotte Street, Sydney, Nova Scotia B1P 1C7 ("Sponsor").
Sponsor's decisions as to the operation and administration of the Contests, receipt of entries, and the type and amount of winnings/prizes are final and binding.

2. CONTEST ELIGIBILITY

A person who participates in any Contest shall be referred to herein as a "Entrant." Entrants must create a User Account in order to enter a Contest. There is no charge or fee to create a User Account.
Age. Entrants must be at least eighteen (18) Years of age, or such higher minimum legal age of majority as stipulated in the jurisdiction of Your residence, to maintain an Account, to enter any Contest or claim any prize.
Excluded States. The Funzpoints Service is available to individuals who are legal residents and located within the United States at time of purchase or play, with the exception that purchases, use of the games and participation in the Sweepstakes Promotions is not available to Users in Idaho and Michigan.
Any person who is an employee, officer, or director of Sponsor or is directly connected with the management of the Contests is not eligible.
The Contests are subject to all applicable federal, state, provincial, territorial, and local laws and regulations. It is the sole responsibility of each Entrant to determine whether their participation is legal and compliant with all regulations in the State in which the Entrant resides.
Participation in any Contest constitutes the Entrant's full and unconditional agreement to these Sweepstakes Rules and Sponsor's decisions, which are final and binding in all matters related to the Contests. Winning a prize is contingent upon fulfilling all requirements set out in these Sweepstakes Rules.
In the event of a dispute as to the ownership of any Premium Funzpoints, the authorized Account holder of the email address used to register the User Account will be deemed to be the Entrant. The "authorized account holder" is the person assigned the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
Premium Funzpoints will automatically expire after an account becomes Dormant. For the purpose of these Sweepstakes Rules, "Dormant" means there has been no game play activity utilizing Premium Funzpoints for a consecutive period of sixty (60) days.
Premium Funzpoints may be forfeited if an Entrant's User Account is deactivated for any reason at Sponsor's sole discretion, or for any other reasons also at the Sponsor sole discretion.

3. PROMOTIONAL PERIOD/SWEEPSTAKES PERIODS

Sweepstakes and Jackpot Giveaways are operated on a daily basis. The Promotional Period for each day shall last for 24 hours, commencing at Midnight 12:00 am Coordinated Universal Time (UTC) and ending at Midnight 12:00 am UTC the next day. Entries received at Midnight or later shall be part of the Contests starting that day at Midnight.

4. HOW TO PLAY IN STANDARD MODE FOR FUN

There are two ways to play Funzpoints (funzpoints.com). You can play in Standard mode using the virtual game credits called "Standard Funzpoints." In Standard mode, there are no prizes. All game wins in Standard mode are virtual wins that hold no value and cannot be redeemed.
No purchase is necessary to play in Standard mode, although users may choose to make a purchase to unlock games, block ads or otherwise for their own entertainment.
You can receive free Standard Funzpoints every three (3) hours by spinning the funzwheel and through other methods available on the Site. Standard Funzpoints are deposited into your Standard Funzpoints wallet associated with your Account.
When a User plays in Standard mode without making a purchase, some games are locked, some mystery booster games are locked, and ads may be displayed at various times during game play. A purchase of Standard Funzpoints will result in games unlocked, mystery boosters unlocked and ad-free play for 30 days. If no purchases have been made within the previous 30 days, games and boosters may be locked and ads may be required for viewing at various points during game play.
You can purchase Standard funzpoints. The quantity of Standard funzpoints associated with each purchase is identified in the purchase screen that can be accessed by selecting the Buy button. All purchases are final and there are no refunds.
If a User requests closure of his/her Account, any balance of Standard Funzpoints is not refundable, has no value, and shall the use of same shall be considered forfeited and waived by User.
All Standard Funzpoints in a User Account at the time of termination of the Account for any reason are cancelled and forfeited.

5. HOW TO ENTER THE PREMIUM SWEEPSTAKES PROMOTION FOR PRIZES

When you purchase Standard Funzpoints, you may also receive a number of virtual game credits called "Premium Funzpoints" as part of the sweepstakes promotion. Premium Funzpoints are deposited into your Premium Funzpoints wallet associated with your Account.
You can play in Premium mode only using Premium Funzpoints. Playing in Premium mode provides a chance to win and accumulate Premium Funzpoints that may - subject to the rules for Redemption Requests stated below - be redeemed for a prize.
Premium Funzpoints awarded for free in connection with a purchase of Standard Funzpoints or otherwise for free through the Site are Restricted Funzpoints for purposes of the eligibility for Redemption, and must be used in a Premium Game at least once prior to being eligible for Redemption for a Prize.
1. The sole exception to this rule is that Premium Funzpoints awarded as a Prize of the Daily Jackpot are not Restricted and may be considered among those Premium Funzpoints in an Account eligible for a Redemption Request.
Premium Funzpoints may be obtained for free without any associated purchase. You may request free Premium Funzpoints to be added to your Account in accordance with the rules below for alternative method of entry.
In Premium mode, all games are unlocked and all ads are removed.
The available prizes that can be won and Game-specific Game Rules while playing a Game in Premium mode are displayed in the "Paytable" of each game.
1. It is the responsibility of the player to review the game Paytable information.

6. HOW TO ENTER THE DAILY JACKPOT SWEEPSTAKES PROMOTION

Virtual "Tickets" for entry in the Daily Jackpot Sweepstakes Promotion are awarded to Users during and in connection with their game play in Standard mode and Premium Mode as indicated in the Ticket counter window on the Site. Tickets awarded through play or otherwise through the Services are deposited into your Ticket wallet associated with your Account.
Each Ticket awarded or won during game play in Standard or Premium Mode is equal to one entry into the Daily Jackpot Sweepstakes Promotion. The chances of winning this Jackpot depend on the number of eligible Tickets entered for the drawing.
All Tickets in your Account at the time of the drawing are automatically entered in the Daily Jackpot Sweepstakes. Tickets will only be entered once and shall be removed from your Account upon entry.
Jackpot Prizes. The number of Prizes and the total amount of Daily Jackpot Prizes for each Sweepstakes period shall be posted on the Site in the Game lobby/selection page. At least one (1) daily jackpot prize is available to be won ("Daily Prize").
Each day, as soon as reasonably possible after 10:00 pm Atlantic Time Zone, winning Tickets shall be selected by random drawing from all Tickets entered in the Daily Jackpot Sweepstakes of the day. Winner(s) shall be notified by email associated with their Account and the winners' Accounts shall be adjusted to reflect the addition of any Prizes.
1. Notice may also be given by on-screen alert, email, website notification, Facebook message, mail or any other method of contact as provided to the Sponsor by the User.
2. It is the sole responsibility of each Sweepstakes User to maintain their contact information or method current. Sponsor shall not be responsible to award any Prizes if User's contact information is not accurate.
Any Premium Funzpoints won as a Prize of the Daily Jackpot will be considered to be unrestricted and qualified for redemption through the Site.
If an Entrant requests closure of his/her Account prior to seeking eligible redemptions, User forfeits and is not entitled to redeem any Premium Funzpoints or claim any Prize.
All Premium Funzpoints in a User Account at the time of termination of the Account for any reason are cancelled and forfeited.
Chargebacks. In the event one or more of an Entrant's purchases on the Site is subject to a charge-back or rejection, all pending redemptions will be cancelled, no further prize redemptions will be allowed, and User's Account may be suspended or terminated in the sole discretion of Sponsor

7. ALTERNATIVE METHOD OF ENTRY - MAIL IN REQUEST

Subject to Account verification procedures, Users may submit a request for 500 free Premium Funzpoints and 10 Tickets to be added to their Account by sending a request card or similar in original handwriting by mailing a request to:

Your submission must:
1. be legible
2. be marked FUNZPOINTS SWEEPSTAKES at the top of the page;
3. be dated
4. list your name, your address, your Funzpoints display name, and the email address that you use with your Account with Funzpoints;
5. state the following in hand-written text signed by you: "I REQUEST FREE SWEEPSTAKES ENTRIES AND I AGREE TO BE BOUND BY THE GENERAL TERMS OF SERVICE AND SWEEPSTAKES RULES AT FUNZPOINTS.COM."
6. be signed by you.
Each mail-in entry must be sent in one mailed envelope per entry.
Redemptions of mail-ins shall be limited to one redemption per 5 working day period.
If your request meets these requirements, 500 Premium funzpoints and 10 Tickets will be credited to Your Account. It is your responsibility to check your Account regularly for your Premium funzpoints and Tickets and to know the status of eligibility of Premium funzpoints.

8. PRIZES & REDEMPTION REQUESTS

Premium Funzpoints have no value whatsoever and only qualify a User to seek redemption of a Prize as set forth herein.
Premium Funzpoints Must Qualify for Redemption. Unless otherwise stated or required by Sponsor, Restricted Premium Funzpoints acquired by Entrant by any method available (eg. in connection with a purchase of Standard Funzpoints or through a mail in Alternative Method of Entry Request) must first be played through in an applicable Premium Mode game at least once before such Premium Funzpoints may qualify to be counted toward the minimum number of Premium Funzpoints eligible for a Prize Redemption request.
1. Upon playing with Restricted Premium Funzpoints, those Premium Funzpoints won and accumulated during game play shall be considered to be eligible for Prize Redemption Requests, subject to the rules for Redemption.
Premium Funzpoints awarded as a Daily Jackpot Prize are not Restricted and such Premium Funzpoints may qualify to be counted toward the minimum number of Premium Funzpoints eligible for a Prize Redemption request.
Potential winners are subject to verification by Sponsor and the decisions of Sponsor are final and binding in all matters related to the sweepstakes.
1. An Entrant is not a winner of any prize, even if the online screen indicates they are, unless and until the Entrant's eligibility and the potential winning play has been verified and the Entrant has complied with these sweepstakes rules and been notified that verification is complete. Sponsor is not required to accept screenshots or other purported evidence of winning, and Sponsor's internal validation process shall solely control.
Potential prize winners must comply with these Sweepstakes Rules and winning is contingent upon fulfilling all requirements set by Sponsor in Sponsor's sole discretion.
If an Entrant wishes to claim any Prize, Entrant may do so by clicking on the "Redeem" button on the site menu option.
Cash Prize. Entrants whom accumulate and maintain 2000 or more qualifying and unrestricted Premium Funzpoints associated with their User Account may elect to claim a Cash Prize by following the redemption method steps on the Site while logged in.
1. Such qualifying Users may claim a Cash Prize corresponding to $1.00 USD for each 100 qualifying Premium Funzpoints User seeks to redeem.
2. Consequently, an Entrant's User Account must have a minimum balance of at least 2000 qualifying Premium Funzpoints before any Cash Prize may be claimed by User.
3. Sponsor may charge a payment processing fee for processing of redemptions, in Sponsor's sole discretion. Such fee if applicable shall not exceed the reasonably estimated costs of the payment processing.
4. Taxes. Sponsor will not be responsible for any federal or state taxes or fees associated with a prize redemption. Entrants are solely responsible for all applicable taxes and fees associated with prize receipt and/or redemption.
5. Premium Funzpoints are non-transferable, and no substitution will be made except as provided herein at the Sponsor's sole discretion.
6. Sponsor reserves the right to substitute the listed prize of equal or greater value for any reason owing to circumstances outside Sponsor's reasonable control.
Prior to any prize redemptions:
1. The name on your credit or debit card or other payment method must match the name appearing on your User Account;
2. Your age, identity and all other required verification checks including but not limited to sources of funds and wealth should be completed;
3. For security reasons and for the prevention of money laundering, we will only authorize a redemption of prizes to a bank or bank account held in your name.
  1. If you provide account details which relate to a bank account held jointly between you and another person, you accept that any prizes will be paid into that joint account. In our discretion, we may require you to supply additional documentation relating to the person who jointly holds the bank account with you so that we may identify and verify the joint account holder.
We will process redemption requests as soon as practicable. All Prize payments are subject to time necessary for verification and payment processing procedures.
The maximum number of Premium Funzpoints that can be redeemed as part of any single request is 200,000 Premium Funzpoints. Sponsor reserves the right to adjust the maximum payout/transfer limit at any time.
1. For Entrants who reside in New York or Florida, the maximum amount number of Premium Funzpoints for redemption requests per day shall not exceed 500,000 Premium Funzpoints and there shall be no Sweepstakes prizes in excess of USD$5,000 with respect to residents of New York or Florida.
If an Entrant requests closure of his/her Account without seeking eligible redemptions User is not entitled to redeem any Premium Funzpoints or claim any Prize.
All Premium Funzpoints in a User Account at the time of termination of the Account for any reason are cancelled and forfeited.
In the event one or more of an Entrant's purchases on the Site is subject to a charge-back or rejection, all pending redemptions will be cancelled, no further prize redemptions will be allowed, and User's Account may be suspended or terminated in the sole discretion of Sponsor.

9. PRIZE AWARDS

Sponsor may, in its sole discretion, forfeit any prize if the User has not provided all personal information to verify eligibility or if the User is not compliant with the Rules and Regulations or Terms of Service. A User is not eligible to collect a sweepstakes prize until their eligibility has been verified. If Sponsor determines that a User is not a valid winner, the prize may be awarded to an alternate potential winner.

10. NO REFUNDS

Internet Disruptions/Connectivity. As stated in the Terms of Service, Sponsor is not liable for any internet disruptions, server downtime, device limitations or any regulatory issues outside of the control of the Sponsor. In the event of any disruptions, Sponsor may, in its sole discretion, decide to provide refunds as a courtesy.
Device vs Server Discrepancy: In the event of a discrepancy between the result showing on a user's device and Woopla's system, the result showing on Woopla's system shall be the official and governing result.
All purchases are final. In the event you believe your Account does not reflect the proper information or numbers of Funzpoints or Tickets or that you otherwise request a credit, correction or refund, such inquiries must be sent to support@Funzpoints.com and must include the User's display name, email address associated with Funzpoints, and details of the purchase transaction including purchase amount, date of purchase, and purchase transaction ID or purchase confirmation number where applicable.
Purchases of Standard Funzpoints are final and are not refundable, transferable or exchangeable. You agree to notify us about any billing problems or discrepancies within 30 days from the date of your purchase. If you do not bring them to our attention within 30 days, you agree that you waive your right to dispute such problems or discrepancies. You are responsible for and agree to reimburse us for all reversals, charge-backs, claims, fees, fines, penalties and any other liability incurred by us (including costs and related expenses) that were caused by or arising out of payments that you authorized or accepted or that were authorized or accepted using your Customer Account, even if not authorized by you.

11. PUBLICITY AND LIABILITY RELEASE

Users agree (1.) that Sponsor, its affiliated companies, promotion and advertising companies, computer servicing companies and security agencies, and all of their respective employees, officers, directors, agents and representatives (individually and collectively referred to as "Sponsor, affiliates, partners and personnel") are released, will have no liability whatsoever for, and shall be held harmless by winners, entrants, and participants against any liability for any losses, damages, or injuries of any kind (whether due to negligence or otherwise) to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, loss, use or misuse of the prize or participation in this Sweepstakes or any Sweepstakes related or travel related activities, and (2.) each potential winner agrees to grant license and permission to Sponsor and those acting under its authority the right to the use of his/her name, at any time or times, in perpetuity, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet, World Wide Web and other media (except where such usage is legally prohibited), without approval, review or notice.

12. FORCE MAJEURE

In the event of flood, fire, earthquake, accident, epidemic, explosion, or other act of God, act of public enemy; act of government, including any governmental order, regulation or order of any court of competent jurisdiction; strike, lockout or other labour dispute; civil or riot commotion; war (whether declared or undeclared) or armed conflict; acts of terrorism; enactment of, rule, or order or act of government or governmental instrumentality (whether federal, provincial, provincial, state or local); or other cause of similar or different nature beyond Sponsor's control (all of which events are referred to herein as "force majeure events"), Sponsor shall have the right to terminate this Sweepstakes drawing without further obligations, if any, hereunder, or at Sponsor's sole option, to suspend the Sweepstakes drawing for a period equal to the duration and the effect of the duration of any such force majeure event.

13. JACKPOT WINNERS LIST

To obtain a list of the name(s) of the Jackpot Sweepstakes winner(s), print your name and complete address on a self-addressed first class stamped envelope and mail to: Funzpoints Winners List, PO Box 537, Sydney, NS B1P 6H4.

14. NON-TRANSFERABLE FUNZPOINTS

Standard funzpoints can only be used for game play in Standard mode and cannot be transferred or converted to Premium funzpoints.
Premium funzpoints can only be used for game play in Premium mode and cannot be transferred or converted to Standard funzpoints.
You cannot transfer Standard funzpoints or Premium funzpoints to any other funzpoints account or person.
You are not permitted to sell your account or provide access to another User or pay another User for their account.

15. MEDIA PERMISSION

Each potential winner agrees to grant permission to Sponsor and those acting under its authority the right to the use of his/her name, at any time or times, in perpetuity, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet, World Wide Web and other media (except where such usage is legally prohibited), without approval, review or notice.

16. RESERVATION OF RIGHTS

Should any portion of the Sweepstakes or Jackpot Giveaway be, in Sponsor's sole opinion, compromised by bugs, worms, virus, non-authorized human intervention, technical failures or any other causes which, in the sole opinion of Sponsor, impair or corrupt the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to modify, suspend, or terminate the Sweepstakes, and select any winner from entries received prior to action taken or as otherwise deemed appropriate and fair by Sponsor.
In the event of any irregular entry for a drawing for any reason whatsoever, Sponsor reserves the right at its sole discretion to modify, suspend, or terminate the Sweepstakes or Jackpot Giveaway.
If you enter this Sweepstakes online, you are solely responsible for the security of your user account. You should take every precaution to keep it safe and private to prevent unauthorized use. Neither Sponsor nor any other person or entity will be responsible for any damages, losses, or consequences you may suffer due to unauthorized or careless use of your account.
The use of improper, unfair, or unauthorized methods to access and enter this Sweepstakes is strictly prohibited, including but not limited to the opening and/or use of multiple accounts, the use of altered or unauthorized hardware or software to assist or alter play (including the use of bots, bot nets, collusion with bots and/or use of gaming programs or software), accessing the Funzpoints from foreign or otherwise ineligible location or IP address, using proxy servers, automated technology, or other means to conceal your identity, any circumstance or act that unfairly alters your chance of winning, gives you an unfair advantage, or constitutes the commission of deception or fraud. Entries determined by the Sponsor to be submitted through such means are not valid entries and are not eligible to win a prize and all associated entries and individuals using such methods may be disqualified for winning prizes in the future.
Sponsor reserves the right to modify, alter, suspend or terminate the Promotion if any federal, provincial or state law, rule or regulation, or any judicial decision or Attorney General Opinion, or any change in any current enforcement policy affects the legality of the Promotion, in whole or in part.
